By accessing or using the NIHILUX website (the "Site") or purchasing goods from us, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions, you may not access the Site or use any of our services.

3. Purchasing, Payment, and Risk of Loss
We utilize Stripe as our primary third-party payment processor. By submitting your payment information, you grant us the right to provide this information to Stripe to facilitate your transaction. We reserve the right to refuse, limit, or cancel any order at our sole discretion. All prices are subject to change without notice. All items purchased from NIHILUX are made pursuant to a shipment contract; risk of loss and title for such items pass to you upon our delivery to the shipping carrier.
4. ALL SALES FINAL / NO RETURNS
All purchases made on NIHILUX are final. We do not accept returns, exchanges, or issue refunds under any circumstances, except in the case of manufacturing defects or items fundamentally damaged during transit. You must report any defective or damaged items to nihiluxhelp@gmail.com within seven (7) days of delivery accompanied by photographic proof. Please carefully review the sizing, color, and product details before submitting your order. By completing a purchase, you acknowledge and explicitly agree to this strict No Return / No Refund policy.
5. Intellectual Property
All content included on this Site, including but not limited to text, graphics, logos, brand names, product designs, images, and software, is the exclusive property of NIHILUX and is protected by United States and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without express written permission from NIHILUX.
6. Limitation of Liability & Warranties
To the maximum extent permitted by applicable law, NIHILUX provides its Site and products "as is" without any warranties of any kind, either express or implied. NIHILUX shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the Site or the performance and use of the products purchased through the Site.
7. Dispute Resolution & Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY – IT AFFECTS YOUR RIGHTS. You and NIHILUX agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your purchase shall be settled by binding, individual arbitration rather than in court. You explicitly waive your right to participate in a class-action lawsuit or class-wide arbitration.
8. Governing Law and Jurisdiction
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal proceedings not subject to arbitration must be brought exclusively in the state or federal courts located in that state.
